intellectual property attorney focused transactions, as well as technology

In Part 1
of our interview series he discusses the State by State legality of the cannabis
industry and the hindrance it causes business. Lance notes Intellectual
Property plays a role in both recreational and medical cannabis. He tells Investor Ideas, “The biggest issue
is, you have to set all this this up in a State. If you are operating as a
brand and you want to expand into another State you’ve got to do it all over
again. The plant you start with, you will have a different source for that in
each State so it’s difficult to maintain that consistency that you would see in
a normal product in other industries in the cannabis industry.”
“A part of that is that you have to be very careful and very clear about the process; here is
what it would require to have a quality
product no matter what State you are in,”
He also discusses the migration of pharmaceutical
and beverage industry experts into the cannabis sector. “A lot of folks from
the pharmaceutical industry are coming into the picture. I’m witnessing that,
and with that comes cool things like a drug delivery platform that’s able to
deliver poorly soluble drugs in the pharmaceutical industry now being applied
to an oil-based extract from the Cannabis plant.” Lance Anderson goes on to
mention how, “A lot of (people) are coming in from the food and beverage
perspective. And again, they have the marketing and branding and distribution
acumen, and are also able to deal with regulatory frameworks that might be more
strict than other consumer goods.”
Mr. Anderson also mentions GW Pharma (
NASDAQ: GWPH) in regard to the perseverance required for the
industry. GW Pharma has had the US Food and Drug Administration approve the first cannabis-derived drug
though it can’t be sold until the Drug Enforcement Administration changes how
it classifies the specific compound used. “GW Pharma has been at
it for a while and are finally seeing the fruits of that,” commented Anderson.
When asked when federal change might happen in the
USA and how far off this might be Anderson said, “I think the train has already
left the station. We’ve allowed for the states to go this far, all the way to
recreational use and in some states, it’s done. I think federal change is in
the near future. We just had the republican party here in Texas vote on their
platform and voted for expanding the laws and decriminalizing. Things that you
would not normally see in a conservative republican platform. If it’s happening
there, then that too me is a good indicator of a sweeping change in the
perspective of our legislators. And why? It’s because of the votes. If you look
at all the surveys and all the polls of voters, they support this. It’s
happening sooner rather than later. It’s already happening. The rescission of
the Cole memo if anything galvanized and caused a more concerted effort to
deliberately address this.”
